In compliance with the general provision of EU Reg. 2016/679 (European Regulation for the protection of personal data) we provide the useful information regarding the processing of personal data provided. 2 - PURPOSE AND LEGAL BASIS OF PROCESSING
The personal data provided will be processed in compliance with the lawfulness conditions set out in Art. 6 of EU Regulation 2016/679, for the following purposes:

a) Browsing this website
• Purpose: to allow navigation on the website and the use of its contents, as well as to ensure the security of the website itself.
• Legal basis: processing necessary for the pursuit of the legitimate interest of the data controller (Art. 6, para. 1, lett. f) GDPR), consisting in the technical management of the website and the protection of IT security.

b) Filling in the form for registration on the website (if applicable)
• Purpose: to allow user registration and the creation of a personal account for access to reserved areas or dedicated services.
• Legal basis: execution of pre-contractual measures taken at the request of the data subject, or performance of a contract (Art. 6, para. 1, lett. b) GDPR).

c) Filling in the data collection form and/or contact request form with the sending of the requested information (if applicable)
• Purpose: to manage requests for information, quotations or contacts submitted by the user through the dedicated form, and to provide feedback.

d) Filling in the data collection form for personnel selection (if applicable)
• Purpose: to evaluate spontaneous applications or applications submitted in response to open positions, and to manage the recruitment process.
• Legal basis: execution of pre-contractual measures taken at the request of the data subject (Art. 6, para. 1, lett. b) GDPR).
• Any processing of special categories of data (Art. 9 GDPR): based on the explicit consent of the candidate, where necessary (Art. 9, para. 2, lett. a) GDPR).

e) Filling in the data collection form to receive newsletters or promotional communications via e-mail (if applicable)
• Purpose: sending informative, promotional or commercial communications relating to the data controller’s products or services, including by e-mail.
• Legal basis: explicit consent of the data subject (Art. 6, para. 1, lett. a) GDPR).
• For existing customers, the sending of promotional communications relating to products or services similar to those already purchased may also be based on the legitimate interest of the data controller (Art. 6, para. 1, lett. f) GDPR and Art. 130, para. 4 of Legislative Decree 196/2003).

3 - DATA PROCESSING
Data processing is based on the article 6, paragraph 1, letter f): (consider 47), considering the reasonable expectations of the data subject at the time and field of the personal data collection, when the interested party can reasonably expect to be processed for this purpose. For specific marketing activities, the legal basis will be the consent.

4 - ADDRESSEES OR CATEGORIES OF ADDRESSEES OF DATA
Data will not be diffused, they may be communicated by MISANO INTERNATIONAL SA to companies contractually linked to MISANO INTERNATIONAL SA , to third parties responsible as Data Processors belonging to the following categories: internet providers, companies specialized in marketing activities and IT and telematic services.
Your data may be transmitted to the police forces and to the judicial and administrative authorities, in accordance with the law, for the detection and prosecution of offenses, the prevention and protection from threats to public safety, to allow MISANO INTERNATIONAL SA to ascertain, exercise or defend a right in court, as well as for other reasons related to the protection of rights and freedoms of others.

5 - Extra-EU data transfer
Some of the third parties listed in the previous paragraph (4) may be located in countries outside the European Union that nevertheless offer an adequate level of data protection, as established by specific decisions of the European Commission.
The transfer of your personal data to countries that do not belong to the European Union and which do not ensure adequate levels of protection will be carried out only after the conclusion between MISANO INTERNATIONAL SA. and those subjects of specific agreements, containing safeguard clauses and appropriate safeguards for the protection of your personal data, also approved by the European Commission, or rather if the transfer is necessary for the conclusion and execution of a contract between you and MISANO INTERNATIONAL SA or for managing your requests.

6 - PERIOD OF CONSERVATION OF DATA OR CRITERIA FOR DETERMINING THE PERIOD
The treatment will be carried out in an automated and manual way, with methods and tools aimed at guaranteeing maximum security and confidentiality. In compliance with the provisions of art. 5 paragraph 1 letter e) of Reg. UE 2016/679 the personal data collected will be stored in a form that allows identification of data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed.
The preservation of personal data provided depends on the purpose of the processing:
- surfing on this website (session);
- for a contact request (maximum 1 year);
- Data collection for staff selection (maximum 24 months);
- receiving newsletters or promotional communications generally via e-mail (maximum 24 months);
- profiling (24 months).

7 - RIGHTS OF THE INTERESTED
You can assert your rights as expressed in the 2016/679 EU Regulation, by contacting the Data Controller, sending an e-mail to info@misanointernational.com">info@misanointernational.com or writing to the office of the owner indicated above. You have the right, at any time, to ask the Data Controller to access to your personal data (Article 15), the correction (Article 16) or the cancellation (Article 17) of the same, or the limitation of processing (art. 18) or to oppose their treatment based on legitimate interest (Article 21). In the end, he has the right to the portability of his personal data (Article 20).

8 - COMPLAINT
If you believe that the processing of your personal data has been carried out unlawfully, you can file a complaint with one of the supervisory authorities responsible for compliance with regard to personal data protection.

Types of Data Processed

The Controller will process personal data as defined by the Regulation, collected during the management of the pre-contractual and contractual relationship, including, by way of example and not limitation, your first name, last name, address, landline and mobile phone number.

Purposes, Legal Basis and Optional Nature of the Processing

Your Personal Data will be processed, without the need for your specific consent, in order to manage pre-contractual and contractual obligations and to comply with legal requirements. The data will be processed for the following purposes:

  • management and execution of pre-contractual obligations and obligations arising from the contract;
  • provision of main and/or ancillary services related to the contract;
  • execution and fulfillment of obligations provided for by laws, regulations and EU legislation, such as tax obligations;
  • management, operational and reliability/solvency assessment needs;
  • management of disputes;
  • allowing access to the Company’s premises by your employees or collaborators.

The legal bases for the processing are the performance of a contract or pre-contractual measures and compliance with a legal obligation. The provision of your Personal Data for the above purposes is optional; however, failure to provide such data will make it impossible to conclude the contract. Promotional activities require your explicit and freely given consent, to be provided in the dedicated section of our website; failure to consent to promotional activities will not affect the execution of the contract or pre-contractual measures; consent may be withdrawn at any time.

Recipients of Personal Data

Your Personal Data may be shared with:

  • individuals authorized by the Controller to process personal data, subject to the signing of a confidentiality agreement (e.g. employees, system administrators);
  • consultants, credit institutions for accounting and administrative purposes, and external companies, some of which act as data processors;
  • subjects, entities or authorities to whom disclosure of personal data is mandatory under provisions of law or orders of authorities.

With regard to any transfer of Data to Third Countries, the Controller informs you that processing will take place in accordance with one of the methods permitted by applicable law, such as the data subject’s consent, the adoption of Standard Contractual Clauses approved by the European Commission, or the selection of entities adhering to international data transfer frameworks or operating in countries deemed adequate by the European Commission. Retention of Personal Data

Your Personal Data will be retained for 10 years. Without prejudice to any longer retention period required by applicable law. Data collected for promotional purposes will be retained for a maximum period of 2 years.

Your Rights

You have the right to request from the Controller, at any time, access to your Personal Data, rectification or erasure thereof, or to object to their processing. You also have the right to request restriction of processing in the cases provided for by Article 18 of the Regulation, as well as the right to receive the data concerning you in a structured, commonly used and machine-readable format, in the cases provided for by Article 20 of the Regulation.

  • compliance with the obligations set forth in Legislative Decree No. 81/2008 on health and safety in the workplace (by way of example, the request for details of your personnel — last name and first name, employee ID number, place and date of birth, date of hiring — who will carry out activities at our premises, together with a specific declaration regarding possession of the required professional and technical suitability, as well as indication of INPS and INAIL registration and the applicable collective bargaining agreement);
  • execution and fulfillment of obligations provided for by laws, regulations and EU legislation;
  • management of disputes.
